 355. সুপারনিউমারারি পোস্ট তৈরির বিষয়ে সিবিআইয়ের তদন্ত, কেলেঙ্কারির প্রকৃতি এবং ব্যাপ্তি এবং এতে জড়িত ব্যক্তিদের আলোতে আনা অপরিহার্য। এটা চমকপ্রদ যে, রাজ্য সরকারের মন্ত্রিসভার স্তরে প্রাপ্ত কর্মসংস্থান রক্ষার সিদ্ধান্ত নেওয়া হয়।

রাষ্ট্রীয় অর্থায়নে পরিচালিত স্কুলগুলির জন্য SSC দ্বারা পরিচালিত একটি নির্বাচন প্রক্রিয়ায় প্রতারণামূলকভাবে, সম্পূর্ণরূপে জেনেও যে, এই জাতীয় নিয়োগগুলি প্যানেলের বাইরে এবং প্যানেলের মেয়াদ শেষ হওয়ার পরে, একেবারে সর্বনিম্নভাবে প্রাপ্ত হয়েছিল৷

 

356. শিক্ষা প্রতিষ্ঠানে বেআইনি নিয়োগ নিশ্চিত করার চেষ্টা করায় এ ধরনের অন্যায় কাজের ব্যাপকতা আরো বেড়ে যায়। এই ধরনের সিদ্ধান্ত গ্রহণের প্রক্রিয়ার সাথে জড়িত ব্যক্তিরা তাই শিশুদের কাছে প্রকাশ করেছে

যারা প্রতারণামূলক উপায়ে তাদের কর্মসংস্থান পেয়েছে।

 

357. সিদ্ধান্ত গ্রহণের প্রক্রিয়ার সাথে জড়িত ব্যক্তিদের সাথে জালিয়াতি এবং এর সুবিধাভোগী ব্যক্তিদের মধ্যে একটি গভীর এবং বিস্তৃত সংযোগ না থাকলে অবৈধ নিয়োগগুলিকে রক্ষা করার জন্য অতিসংখ্যার পদ তৈরির সমাধানে এই ধরনের পদক্ষেপ অকল্পনীয়। তদুপরি, জড়িত ব্যক্তিদের প্রত্যেকেই ভারতের সংবিধানের অনুচ্ছেদ 14 এবং 16 লঙ্ঘন করেছে। এই ধরনের লঙ্ঘনের ফলে অপরাধমূলক দায় হয়েছে কিনা

তদন্ত করা উচিত।

 

358. যেহেতু কেলেঙ্কারির সুবিধাভোগীদের অন্তত একটি অংশের অর্থ হল, প্যানেলের বাইরে এবং প্যানেলের মেয়াদ শেষ হওয়ার পরে নিয়োগপ্রাপ্তদের মধ্যে কিছু ব্যক্তি এবং ফাঁকা OMR শীট জমা দেওয়ার পরে নিযুক্ত ব্যক্তিদের চিহ্নিত করা হয়েছে, তাই এটি উপযুক্ত হবে এই ধরনের ব্যক্তিদের প্রতারণামূলক উপায়ে তারা প্রাপ্ত সুবিধা এবং ফল ফেরত দেওয়ার নির্দেশ দেয়। এগুলো অপরাধের আয়। অতএব, আমরা প্রত্যাবর্তন এবং তা পুনরুদ্ধারের জন্য নির্দেশ জারি করার প্রস্তাব করছি।

 

359. সমগ্র পর্বে তাদের ভূমিকাও তদন্ত করা উচিত। ফলস্বরূপ, আমরা সেই বিষয়েও নির্দেশনা জারি করার প্রস্তাব করছি। এটা জরুরী যে তাদের ভূমিকারও তদন্ত করা হবে যাতে সম্ভব হলে শনাক্ত করা যায় যে, কোন পদ্ধতিতে জালিয়াতি করা হয়েছিল।

 

 

ব্যতিক্রম

360. এই কার্যক্রমের মুলতুবি থাকাকালীন, বিদগ্ধ একক বিচারক মিসেস সোমা দাস নামে একজন প্রার্থীর দুর্দশার কথা নোট করেছিলেন এবং সেই বিষয়ে 2022 সালের WPA 6836 হিসাবে একটি রিট পিটিশন নিবন্ধনের নির্দেশ দিয়েছিলেন। মিসেস সোমা দাস পরবর্তীতে 2022 সালের WPA 6942 দায়ের করেছিলেন যেখানে 18 এপ্রিল, 2022 তারিখের একটি আদেশ বিজ্ঞ একক বিচারক দ্বারা পাস করা হয়েছিল। সেখানে, বিজ্ঞ একক বিচারক মিসেস সোমা দাসের চিকিৎসার অবস্থার কথা নোট করেছিলেন এবং রাজ্য সরকারকে মানবিক ভিত্তিতে তাকে একটি চাকরি দেওয়ার কথা বিবেচনা করার অনুরোধ করেছিলেন।

361. বিষয়গুলির শুনানির সময়, আমাদের সামনে, এটি পেশ করা হয়েছে যে, মিসেস সোমা দাসের ক্ষেত্রে আদালতের একটি ব্যতিক্রম করা উচিত, যেহেতু তার নিয়োগ সম্পূর্ণরূপে মানবিক কারণে হয়েছিল৷

 

362. আমরা 2022 সালের WPA 6942-এ পাস করা 18 এপ্রিল, 2022 তারিখের আদেশটি বিবেচনা করেছি এবং দেখতে পেয়েছি যে, মিসেস সোমা দাসের নিয়োগের বিবেচনার জন্য অনুরোধটি সম্পূর্ণরূপে মানবিক কারণে করা হয়েছিল এই ধরনের ব্যক্তির চিকিৎসার কারণে। মিসেস সোমা দাসকে রাজ্য সরকার সম্পূর্ণরূপে মানবিক কারণে নিয়োগ দিয়েছে। ফলস্বরূপ, আমরা তার নিয়োগে ব্যাঘাত না করার প্রস্তাব করছি, কারণ রাষ্ট্র মানবিক কারণে তার নিয়োগ মঞ্জুর করেছে। তিনি পরবর্তীতে জারি করা নির্দেশের বাইরে থাকবেন।

 

দিকনির্দেশ

363. উপরের আলোচনার পরিপ্রেক্ষিতে, আমরা নিম্নলিখিতটি জারি করছি

নির্দেশনা:-

(i) এই বেঞ্চের মার্চ, 2024 এর মাসিক তালিকায় উপস্থিত রিট পিটিশনগুলি, যেগুলি 2021 এবং 2022 সালে দাখিল করা হয়নি এবং সংখ্যাযুক্ত হয়নি এখতিয়ার/সংকল্পের অভাবের কারণে তালিকা থেকে মুক্তি দেওয়া হয়েছে৷

 

(ii) ভারতের সংবিধানের অনুচ্ছেদ 14 এবং 16 লঙ্ঘন করার সাথে জড়িত বাছাই প্রক্রিয়ায় প্রদত্ত সমস্ত নিয়োগ বাতিল এবং বাতিল ঘোষণা করা হয় এবং বাতিল করা হয়।

(iii) তিনটি হার্ড ডিস্কে উপলব্ধ ওএমআর শীটগুলি, যদি ইতিমধ্যে করা না হয়ে থাকে বা এই জাতীয় অংশটি করা না হয় তবে অবশ্যই এসএসসির ওয়েবসাইটে আপলোড করতে হবে এবং জনসাধারণের কাছে দেখার জন্য উপলব্ধ করতে হবে।

(iv) প্যানেলের বাইরে নিযুক্ত ব্যক্তিদের, প্যানেলের মেয়াদ শেষ হওয়ার পরে এবং যারা ফাঁকা ওএমআর শীট জমা দিয়েছিলেন কিন্তু অ্যাপয়েন্টমেন্ট পেয়েছেন, তাদের প্রাপ্ত সমস্ত পারিশ্রমিক এবং সুবিধাগুলি রাষ্ট্রীয় কোষাগারে ফেরত দিতে হবে এবং প্রতি 12 শতাংশ হারে গণনা করা সুদের সাথে বার্ষিক, তা প্রাপ্তির তারিখ থেকে আমানত পর্যন্ত, তারিখ থেকে চার সপ্তাহের মধ্যে।

 

(v) ডিফল্টভাবে, জেলা ম্যাজিস্ট্রেট যাদের এখতিয়ারের অধীনে, এই ধরনের প্রার্থীরা থাকেন, তারা ভূমি রাজস্বের বকেয়া হিসাবে এই জাতীয় ব্যক্তির কাছ থেকে এই পরিমাণ অর্থ আদায়ের জন্য দ্রুত পদক্ষেপ নেবেন এবং নিশ্চিত করবেন যে তারিখের ছয় সপ্তাহের মধ্যে পুনরুদ্ধার করা হয়েছে। পুনরুদ্ধারের জন্য পদক্ষেপের সূচনা।

(vi) স্কুলের সংশ্লিষ্ট জেলা পরিদর্শকগণ সংশ্লিষ্ট জেলা ম্যাজিস্ট্রেটদের রিপোর্ট করবেন যে সংশ্লিষ্ট ব্যক্তিদের দ্বারা অর্থ প্রদানের নির্দেশিত অর্থ রাষ্ট্রীয় কোষাগারে দেওয়া হয়েছে কি না।

 

(vii) চারটি ক্ষেত্রেই CBI আরও তদন্ত করবে৷ CBI প্যানেলের মেয়াদ শেষ হওয়ার পরে এবং ফাঁকা OMR শীট জমা দেওয়ার পরে প্যানেলের বাইরে অ্যাপয়েন্টমেন্ট পেয়েছিলেন এমন সমস্ত ব্যক্তিদের জিজ্ঞাসাবাদ করবে। প্রয়োজনে সিবিআই তাদের প্রত্যেককে হেফাজতে জিজ্ঞাসাবাদ করবে।

 

(viii) সিবিআই জড়িত ব্যক্তিদের বিষয়ে আরও তদন্ত করবে, রাজ্য সরকার বেআইনি নিয়োগের জন্য সুপারনিউমারারি পোস্ট তৈরি করার অনুমোদন দিয়েছে। প্রয়োজনে সিবিআই জড়িত ব্যক্তিদের হেফাজতে জিজ্ঞাসাবাদ করবে।

(ix) সিবিআই এখানে নির্দেশিত আরও তদন্তের বিষয়ে তার রিপোর্ট পেশ করবে, বিশেষত তারিখ থেকে তিন মাসের মধ্যে, বিচার বিভাগীয় আদালতে।

 

(x) উপযুক্ত নির্দেশনা চাইতে SIT-কে অনুমতি দেওয়া হয়েছে যাতে তদন্ত এবং বিচারগুলি তাদের যৌক্তিক সিদ্ধান্তে আসে।

(xi) এসএসসি এই নির্বাচন প্রক্রিয়ার সাথে জড়িত ঘোষিত শূন্যপদের বিষয়ে একটি নতুন নির্বাচন প্রক্রিয়া গ্রহণ করবে, যা পরবর্তী নির্বাচনের ফলাফল ঘোষণার তারিখ থেকে এক পাক্ষিকের মধ্যে পছন্দ করে।

(xii) OMR শীট প্রস্তুত, মূল্যায়ন এবং স্ক্যান করার জন্য নিয়োগ SSC দ্বারা উন্মুক্ত দরপত্রের মাধ্যমে এবং যোগ্যতার শর্তাবলী এবং চুক্তির অন্যান্য শর্তাবলী ঘোষণা করার পরে করা হবে।

(xiii) SSC অক্ষরে অক্ষরে বাছাই প্রক্রিয়া পরিচালনাকারী নিয়ম অনুসরণ করবে।

 (xiv) SSC নির্বাচনের যেকোন বিভাগকে নিয়ন্ত্রিত নিয়োগ বিধি মেনে চলার বিষয়ে সমস্ত নীতিগত সিদ্ধান্ত উপলব্ধ করবে

                        Sub: Preponement of Summer Vacation

This notification is in compliance with the Memo No.590-SED/Admin Date: 18.04.2024 of School Education Department, Government of West Bengal, all the recognized schools under the academic/administrative jurisdiction of West Bengal Board of Secondary Education except for those schools located in the hill areas of Darjeeling and Kalimpong districts, are hereby notified that considering the prevailing heat wave situation, the summer vacation stands preponed w.e.f. next Monday i.e. 22.04.2024. The schools of the hill areas of Darjeeling and Kalimpong districts existing academic schedule may continue until further order.

The teaching and non-teaching staff shall enjoy the leave as a special case during the period or till the schools reopens, subject to the directions issued by concerned Election Authorities in view of ensuing Parliament General Elections, 2024, and/or when required for fulfilment of activities and responsibilities for execution of various student's welfare programmes of Government of West Bengal, and/or for any special direction issued by School Education Department, Government of West Bengal and/or West Bengal Board of Secondary Education.

Subsequent to re-opening of schools as per WBBSE Notification No. DS(ACA)/131/A/25/4, dated 01.04.2024, the Teaching/ Non-teaching staff of schools are to make suitable arrangements, appropriate to the institution, in the interest of the students, for conducting extra classes to offset the losses of classes due to proponent of summer vacation as stated above.

All Head of the Institutions of schools are requested to take necessary action accordingly.

This is issued in partial modification of earlier notifications in this regard, with the approval of the President, Ad Hoc Committee, WBBSE.

b) 24lh April, 2024 (Wednesday) to 27,h April, 2024 (Saturday) (04 days) only in the districts of Darjeeling, Kalimpong, Uttar Dinajpur, Dakshin Dinajpur, going for elections in phase 2, to be held on 26lh April, 2024. c) Summer Holidays stand.revised from 6,h May, 2024 (Monday) to 2IKl June, 2024 (Sunday) (22 days excluding holidays and Sunday).

The President, Ad-hoc-Committee, W.B.B.S.E. has decided that this circular be issued for General information that the prayer for Resignation and Voluntary Retirement of approved teaching and Non-teaching staff of the schools will bc 'submitted to W.B.B.S.E. through the District Inspector of Schools (S.E.) of the concerned Districts. I extend our heartfelt appreciation on behalf of the Board in advance with the expectation of committed service as an Examiner/Head Examiner for the Madhyamik Pariksha (SE), 2024 in the interest of the candidates and their welfare. The Board understands the magnitude of responsibility and dedication involved for each concerned in this crucial task.

By the direction of the President, Ad-hoc. Committee, West Bengal Board of Secondary Education, I am to notify that the compensatory leave will be admissible for the duties performed on specific dates in lieu of personal presence in the conduct of evaluation process on 18.02.2024 (Sunday), 25.02.2024 (Sunday), 26.02.2024 (Shab-E-barat) and 08.03.2024 (Shivaratri).

For compensatory leave by the concerned Head Examiners/Examiners of Madhyamik Pariksha (SE), 2024, they shall have to be personally present on said dates and subsequently with the proof of attendance on the mentioned dates, have to apply for the compensatory leave to the concerned Head of the Institution, and avail the same within 30th April 2024, excluding on all days of examination, in between.

Furthermore, the Head of the Institution are requested to allow Compensatory Leave to the concerned teachers who have been selected as Head Examiner/Examiner, on production of the relevant papers, as per the terms and conditions of this notification.
